Assignment Title: Local Legal Consulting Services

Georgia has received financing from the World Bank towards the cost of the Third Secondary and Local Roads Project and intends to apply part of the proceeds to payments for goods, works, and related services and consulting services to be procured under this project which will be jointly financed by the Government of Georgia.

The Roads Department of the Ministry of Regional Development and Infrastructure of Georgia (RDMRDI) now invites Individual Consultants (Consultants) to express their interest in providing the following services: “Local Legal Consulting Services”.

Interested individuals shall provide information demonstrating that they have the necessary experience to perform the aforesaid services. CVs of the candidates should cover experience in relevant to the project activities.

The contract is expected to last 70 days (nonconsecutive) over a six month period. It is expected that the consultant will work mostly in Tbilisi, with around 30 days of field work.

Objective of the Assignment:

The main objective of the assignment is to help the Infrastructure Development Department of MRDI of Georgia and local governments to improve the current maintenance system through confirming the feasibility of piloting road maintenance micro-enterprises and the applicability of the proposed approach to Georgia context. The assignment is to focus on updating the results and findings of the Feasibility Study carried out in 2010 and developing the implementation strategy and the design of a pilot micro-enterprise program for the rural/local roads maintenance.

Aiming to improve current maintenance system, RD will hire 3 individual consultants (international consultant with experience in Micro Enterprises (MEs), local corporate legal specialist and local engineer), with the scope to find out the conformity of the proposed concept to Georgia.

  1. Update of the feasibility study of 2010, given the current context of the sector of the country.
  2. Study legal aspects and Identification of the best suitable legal form of the MEs.
  3. Identification of two or three best suitable regional roads for MEs.
  4. Regional visits for research of local people’s social background willingness and readiness for MEs.
  5. Analysis, assessment and recommendations, pros and cons of the concept.
  6. Proof of the potential economic benefits from the MEs outweigh the required effort in creating, training and managing those MEs. 

The International Rural Transport Consultant is expected to lead the consultant team comprising from 2 local consultants. The Legal Consultant will assist the International Consultant in the adapting the proposed Pilot on Routine Maintenance through Microenterprises strategies to the Georgian context and needs and in the collection and translation of data related to legal aspects of road maintenance and road works contracting in Georgia. 

The Consultant will be selected under Chapter V “Selection of Individual Consultants” selection method for a Lump-Sum contract, as described in the World Bank’s Guidelines: Selection and Employment of Consultants [under IBRD Loans and IDA Credits & Grants] by World Bank Borrowers, January 2011, revised July 2014 (“Consultant Guidelines”).

The attention of interested Consultants is drawn to paragraph 1.9 of the World Bank’s Guidelines: Selection and Employment of Consultants [under IBRD Loans and IDA Credits & Grants] by World Bank Borrowers, January 2011, revised July 2014 (“Consultant Guidelines”), setting forth the World Bank’s policy on conflict of interest.  In addition, please refer to the following specific information on conflict of interest related to this assignment: The consultant shall not receive any remuneration in connection with the assignment except as provided in the contract. The consultant and its affiliates shall not engage in consulting or other activities that conflict with the interest of the client under the contract. The contract shall include provisions limiting future engagement of the consultant for other services resulting from or directly related to the firm’s consulting services in accordance with the requirements of paragraphs 1.9 and 1.10 of the Guidelines.

Required Qualification of the Consultant:

  • Degree in Law (advanced degree will be an advantage);
  • At least  4 years of professional experience;
  • Thorough knowledge of the Georgian Civil Code;
  • Good understanding of the Georgian Tax Code;
  • Prior experience establishing microenterprises will be an advantage;
  • Prior experience working with Local Governments and communities will be an advantage;
  • Experience drafting contracts, charters;
  • Languages: Georgian (required), English (mandatory).
